Terms and Conditions for the Prepaid Card
This document constitutes the agreement (Agreement") outlining the terms and conditions under which a MasterCard Gift Card Prepaid Card ("Card") has been issued to you. By accepting and using this Card, you agree to be bound by the terms and conditions contained in this Agreement. In this Agreement "You" and "your" mean the person or persons who have received the Card and are authorized to use the Card as provided for in this Agreement. "We", "us", "our", and "Issuer" mean Newcastle Building Society, our successors, affiliates or assignees. The Card will remain the property of the issuer and must be surrendered upon demand. The Card is nontransferable, and it may be canceled, repossessed, or revoked at any time without prior notice subject to applicable law. Please read this Agreement carefully and keep it for future reference.
The Card is a MasterCard Gift Card Prepaid Card loaded with a specific value which can be used to pay for goods and services from any merchant where the MasterCard Acceptance Mark is displayed. The card is an electronic money device. The value of your card is held as electronic money, not a deposit. You will not earn any interest on the balance on your card. The Card is not connected to any other account owned by you.
Our business hours are 9.00- 17.00 are Monday through Friday excluding holidays.
1. Authorised Users
Applicants must be 18 years old or over and a UK resident. Cardholders must be 14 years old or over and must sign the signature strip on the reverse of the Card upon receipt. You are wholly responsible for the use of the Card according to the terms of this Agreement.
Before using the card you will need to:
- Sign the signature strip on the back of the card
- Activate the Card via the www.qcsgiftcards.com/mastercardgiftcard website.
- Accept these Terms and Conditions
- Keep the Card secure at all times and not allow any other person to use it.
2. Using your Prepaid Card
Detailed instructions on how to use your Prepaid Card are found on the Website. You will need to follow these instructions when using your Prepaid Card.
We will deduct the value of your transactions from the balance on your Prepaid Card as soon as they are made. We will also deduct any applicable fees as soon as they become payable by you. If sufficient funds are not loaded on your Prepaid Card at the time of a transaction to cover the amount of the transaction and the fees, the transaction will be declined. If you want to make a transaction of a greater value than that loaded onto the card you must tell the checkout person that you want to make a ‘split transaction’ before handing over the card and they need to deduct the specific card value first. The retailer may request that you pay the balance in cash. Nevertheless, if a transaction that exceeds the balance of the funds available on your Card occurs due to a system malfunction or otherwise, you shall remain fully liable to us for the amount of the transaction and any applicable fees or charges.
You may use your Prepaid Rewards Card to obtain goods and services wherever the MasterCard Acceptance Mark is displayed except:
- For any illegal purposes
- Where the card is also used for identification purposes e.g. car rentals, hotels, massage parlours, escort agencies, and certain types of mail order.
- Automated fuel dispensers (Payment for pay-at-the-pump stations must be made inside)
- Gambling.
- To obtain cash.
- Where there is no real time transaction.
Your card can not be used for manual transactions e.g. zip zap machines.
The card is non re-loadable. It will have been loaded with a specific value. Once the value has been used it should not be re-presented as it will be declined. After use the card should be destroyed.
If you use your Card number without presenting your Card (such as for a web, mail order or telephone purchase), the legal effect will be the same as if you used the Card itself.
If you commence a purchase and then change your mind and fail to make the purchase, after the merchant has already obtained an "authorisation" for the transaction, the "authorisation" may result in a temporary hold for that amount of funds for up to ten (10) days.
YOU ARE NOT ALLOWED TO USE THE CARD FOR UNAUTHORISED PURCHASES OR TO EXCEED THE REWARD VALUE OF FUNDS AVAILABLE ON YOUR CARD.
You do not have the right to stop payment on any transaction made with your Card.
3. Our liability
Like other payment cards, we cannot guarantee a retailer will accept your Prepaid Card, or that we will necessarily authorise any particular transaction. This may be because of a systems problem, something outside our reasonable control, or because we are concerned that your Prepaid Card is being misused. Accordingly, we shall not be liable in any event that a retailer refuses to accept your Prepaid Card, or if we do not authorise a transaction, or if we cancel or suspend use of your Prepaid Card e.g. if access to your Card has been blocked after you reported your Card lost or stolen. Unless otherwise required by law, we shall not be liable for any direct or indirect loss or damage you may suffer as a result of your total or partial use or inability to use your Prepaid Card, or the use of your Prepaid Card by any third party. In the event that you do not use your Prepaid Card in accordance with these Terms and Conditions or we find that you are using the Prepaid Card fraudulently, we reserve the right to charge you for any reasonable costs that we incur in taking action to stop you using this Prepaid Card and to recover any monies owed as a result of your activities.
4. Disputes with retailers
If you have any disputes about purchases made using your Prepaid Card, you should settle these with the person you bought the goods or services from. We are not responsible for the quality, safety, legality or any other aspect of any goods or services purchased with your Prepaid Card. Remember that once you have used your Prepaid Card to make a purchase we cannot stop that transaction.
5. Returns and Refunds
You have the right to redeem the funds on your prepaid card at any time in whole or in part. To do so, please either send us an e-mail using the contact us facility on the Website, or contact us by telephone on 0871 200 1484, requesting redemption and indicating the amount to be redeemed.
If you request redemption of all funds on your Prepaid Card, please confirm in writing that you have destroyed your Prepaid Card by cutting it up. When we process your redemption request, we may require you to provide us with documents such as identification so that we may process your request in accordance with legal requirements. We may also charge a redemption fee if one of the following circumstances applies:
- You are requesting redemption before termination or expiry of this agreement
- You cancel this agreement before any agreed termination or expiry date
- You request redemption more than one year after the date of termination or expiry of this agreement
Please see the fee summary table for a summary of fees including redemption fees. We will not redeem the value of the funds on your card to you if your request for redemption of the funds is more than six years after the date of termination or expiry of this agreement. Your e money agreement expires 12 months after the card expiry date
6. Keeping your Prepaid Card secure
You should treat your Prepaid Card like cash. If it is lost or stolen, you may lose some or all of your money on your Prepaid Card, in the same way as if you lost cash in your wallet or purse. As a result, you must keep your Prepaid Card safe and not let anyone else use it.
If you lose your Prepaid Card or it is stolen, or you suspect that your Prepaid Card has been used by someone other than you, you must tell us immediately by calling us on our 24 hour lost and stolen card helpline 0871 200 1484 so we can cancel your Prepaid Card.
7. Card Expiry
Your Prepaid Card will be valid for a period of 1 year.
On expiry of your Prepaid Card, you will not be provided with a replacement card. However, you may contact us to seek redemption of the remaining funds on your Prepaid Card by following the process described in Section 5.
8. Foreign Transactions
There is a charge for foreign transactions at a rate of approximately 3% of the total transaction value. The rate may vary and MasterCard reserves the right to change this rate at any time. This is applied at the time of transaction.
9. Receipts
You should get a receipt at the time you make a transaction using your Card. You agree to retain your receipt to verify your transactions.
10. Privacy and Data Protection
(i) Information We Collect ("Cardholder Information"):
(a) Information about purchases made with the Card, such as date of purchase, amount and place of purchase; and
(b) Information you provide to us when you apply for a Card, when you activate a Card or when you contact us with customer service issues.
(ii) Information Security: Except as otherwise disclosed to the Cardholder, only those persons who need it to perform their job responsibilities are authorised to have access to Cardholder Information. In addition, we maintain physical, electronic and procedural security measures that comply with regulations to safeguard Cardholder Information.
(iii) Disclosure: We may use Cardholder Information to provide customer services, to process claims for lost or stolen Cards, to develop marketing programs, to help protect against fraud and to conduct research and analysis. In addition, it is often necessary for us to disclose Cardholder Information for the same purposes to companies that work with us. For example, we may provide certain Cardholder Information to companies that perform business operations or services, including marketing services, on our behalf. We may also provide certain Cardholder Information to others as permitted by law.
11. Your rights and our obligations
Your Card and your obligations under this Agreement may not be assigned. We may transfer our rights under this Agreement. Use of your Card is subject to all applicable rules and customs of any clearinghouse or other association involved in transactions. We do not waive our rights by delaying or failing to exercise them at anytime. If any provision of this Agreement shall be determined to be invalid or unenforceable under law, the validity or enforceability of any other provision of this Agreement shall not be affected. This Card is issued by the Issuer pursuant to license from MasterCard International.
12. Amendment and Cancellation
You have a legal right to cancel your Prepaid Card up to 14 days after you receive the Prepaid Card without being charged the Redemption Fee.
If you cancel your Prepaid Card, once all transactions and fees have been deducted, we will arrange for any unused funds to be refunded to you, see "Your Rights to Redemption of Funds and Refunding of Transactions on your Prepaid Card" section below for further information. A Redemption Fee may be charged (see Fees section) unless you have arranged to transfer any unused funds to another Prepaid Card managed by us, or you cancel your Prepaid Card within 14 days of receiving it. If another card is issued a new e-money agreement will commence
13. Customization
(1) You warrant to the Issuer that:
You are the owner of the image (e.g. it is a photo taken by you) or you have obtained express consent from the image’s owner to use the image on your card; and use of the image by the Issuer will not infringe any other person’s rights, including intellectual property rights, in the image. The Issuer may require evidence of the image owner’s consent or of your ownership of the image.
3. You grant to the Issuer or have obtained from the image owner the grant to a perpetual, non-transferable, non-exclusive, royalty-free, world-wide, irrevocable license to use the image and the data you provide to the Issuer name for the purpose of providing your customized card to you.
4. You consent (or you will obtain consent from the image’s owner) to the Issuer storing, modifying, copying or using the image. The Issuer may also require evidence of this consent.
5. All copyright and intellectual property rights in the customized card program vest in the Issuer (excluding the image), and your participation in the program does not result in the transfer or license any of the Issuer’s or its third party supplier(s)’ intellectual property rights to you unless otherwise expressly stated in your cardholder agreement. You will not reproduce any of the Issuer or its third party suppliers) intellectual property (without express consent).
6. You agree that you have read and understood the Image Area Guidelines, and that you will only submit images that comply with the Image Area Guidelines.
7. You warrant that, as far as you are aware, the image does not contain any computer viruses.
8. You indemnify MasterCard and the Issuer against any claims arising or loss suffered by the Issuer and/or MasterCard as a result of the image being used on your customized card and reproduced on your card, or in respect of the Issuer storing, modifying, copying or using the image.
14. Complaints
The Gift Cards are managed by Quantum Card Services. If you are unhappy in any way with your Prepaid Card or the way it is managed, tell us by using the e-mail enquiry facility on the Website so we can investigate the circumstances for you. Any complaints you have will be dealt with quickly and fairly. You may be able to take unresolved complaints to the Financial Ombudsman Service at South Quay Plaza, 183 Marsh Wall, London E14 9SR. 15. Compensation
The Prepaid Card is an electronic money (E Money) product. Although the product is regulated by the Financial Services Authority (FSA), the Financial Services Compensation Scheme (FSCS) does not apply to this product. No other compensation scheme exists to cover losses with this product. This means that in the unlikely event that Newcastle Building Society becomes insolvent, the card may become valueless and unusable, and you may lose your money. By using this product, you confirm that understand and accept these risks.

If you lose or damage your card and need a replacement there is charge of £5
17. Arbitration Disclosure and Application of Law:
The agreement is subject to UK law.
